This agreement applies as between you, the User of this website and NA Sher Foundation, c/o Hannah Sher, 13 Sher Ln, Chelsea, ME 04330, the operator(s) of this website (hereinafter “NA Sher Foundation”, “we”, “us” or “our”). Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the website. If you do not agree to be bound by these terms and conditions, you should stop using the website immediately.

   2. To make the website and Services available to you, you hereby grant us a royalty-free, non-exclusive, worldwide license to copy, display, use, broadcast, transmit and make derivative works of any content you publish, upload, or otherwise make available to the website. We claim no further proprietary rights in your Content.

1. User Obligations

   2. You may also provide personal information, including, but not limited to, your name. 

   3. You are responsible for ensuring the accuracy of this information.       3. To upload or otherwise disseminate any computer viruses or other software that may damage the property of another.

      4. To perpetrate any fraud.

      5. To publish or distribute any obscene or defamatory material.

      6. To publish or distribute any material that incites violence, hate, or discrimination towards any group.

      7. To unlawfully gather information about others.

1. Donation Specific Terms

By using the services of the donation, you as a user (hereinafter referred to as donor) agree to these terms and conditions.

1. Validity. These terms and conditions apply to all donations within the scope of NA Sher Foundation’ activity and irrespective of the classification under contract law. They also apply to all future donations without the need for explicit acceptance. These terms and conditions shall be deemed accepted at the latest with your first donation. These terms and conditions as well as all further amendments are available online on NA Sher Foundation website and apply exclusively. NA Sher Foundation reserves the right to amend these terms and conditions in any form at any time, without further notice and at its own discretion. Notification of changes at this point is recognised by the donor as sufficient notice.

2. Scope. The donor turns his/her donation over to NA Sher Foundation, which first adds it to its assets and then allocating it to the development of its website or the purposes specified. The purpose of the donation is fulfilled by NA Sher Foundation by using the funds received within the framework of NA Sher Foundation’ own purposes to develop NA Sher Foundation. NA Sher Foundation decides on the use of the donations in respect to the development. There is no legal claim on the part of the donor or the favored part of NA Sher Foundation. The donor agrees to the transmission of the data required for the transfer of the donation to the implementing banks or to the transmission of the data required for the implementation of the donation by PayPal.

3. Data protection of donors. NA Sher Foundation uses SSL encryption technology when transmitting data. The data of the donors will only be stored for a short period of time for accounting, security, and research reasons. The data is used exclusively for the purpose of transferring the donation to NA Sher Foundation. The donor's personal data may be used by NA Sher Foundation for the purpose of producing a donation receipt for the donor. Furthermore, the data may be used to remedy technical defects. They will not be forwarded to other organizations.

4. Donors Responsibilities. By donating to NA Sher Foundation you agree to provide true, accurate and up-to-date information about yourself as specified in the donation form. If it becomes known that any of the information you provide is untrue, inaccurate, outdated, or incomplete, NA Sher Foundation reserves the right not to accept you as a donor in the future and to take other legal action if necessary. Donors undertake to comply with all applicable legal provisions when donating in order to prevent unlawful use. Furthermore, donors undertake to assume sole responsibility for compliance with such legal provisions.

1. Assumption of Risk

The website and Services are provided for communication purposes only. You acknowledge and agree that any information posted on Our website is not intended to be legal advice, medical advice, or financial advice, and no fiduciary relationship has been created between you and us. You further agree that your purchase of any of the services on the website is at your own risk. We do not assume responsibility or liability for any advice or other information given on the website.

   2. Further, we shall not be liable for direct, indirect consequential, or any other form of loss or damage that may be suffered by a user using the NA Sher Foundation website including loss of data or information or any kind of financial or physical loss or damage.

In no event shall NA Sher Foundation, nor its Owner, directors, employees, partners, agents, suppliers, or affiliates, be accountable for any indirect, incidental, special, eventful, or exemplary costs, including without limitation, loss of proceeds, figures, usage, goodwill, or other intangible losses, consequential from (i) your use or access of or failure to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content attained from the Service; and (iv) unlawful access, use or alteration of your transmissions or content, whether or not based on guarantee, agreement, domestic wrong (including carelessness) or any other lawful concept, whether or not we've been aware of the possibility of such damage, and even if a cure set forth herein is originated to have futile of its important purpose.

   2. If any part or sub-part of this Agreement is held invalid or unenforceable by a court of law or competent arbitrator, the remaining parts and sub-parts will be enforced to the maximum extent possible. In such a condition, the remainder of this Agreement shall continue in full force.

   3. If we fail to enforce any provision of this Agreement, this shall not constitute a waiver of any future enforcement of that provision or any other provision. Waiver of any part or sub-part of this Agreement will not constitute a waiver of any other part or sub-part.

   4. Headings of parts and sub-parts under this Agreement are for convenience and organization, only. Headings shall not affect the meaning of any provisions of this Agreement.

   5. No agency, partnership, or joint venture has been created between the Parties because of this Agreement. No Party has any authority to bind the other to third parties.

   6. We are not liable for any failure to perform due to causes beyond its reasonable control including, but not limited to, acts of God, acts of civil authorities, acts of military authorities, riots, embargoes, acts of nature, and natural disasters, and other acts which may be due to unforeseen circumstances.

   7. The terms herein will be governed by and construed by the laws of Maine, United States without giving effect to any principles of conflicts of law. The Courts of Kennebec County, Maine, United States shall have exclusive jurisdiction over any dispute arising from the use of the website.
